  • Template: Essential Critical Infrastructure Worker Letter (The National Restaurant Association)The Restaurant Law Center drafted a letter specifically for restaurant employers that they can amend to give to their essential employees stating that the holder is an “Essential Critical Infrastructure Worker” under the U.S. Department of Homeland Security guidelines. Sunday, March 15th,  Governor Newsom directed restaurants statewide to cut their seating capacity in half and practice “social distancing” between guest parties.

Monday, March 16th,  Governor Newsom moved away from that request and directed restaurants statewide to operate only via take out, delivery, drive thru, and curb side pick-up.

Monday, March 16th, Governor Newsom moved away from that request and directed restaurants statewide to operate only via take out, delivery, drive thru, and curb side pick-up.

Thursday, March 19th, Governor Newsom announced a statewide “shelter in place” policy, which will continue to allow restaurants statewide to operate on a limited basis providing take-out, drive thru, and delivery services to consumers.

The Governor’s Executive Order

The Governor’s Full Guidance includes information for businesses operating food trucks, cafeterias, grocery stores and charitable food distribution sites.

FAQ from the California Department of Public Health (CDPH)

The California Department of Public Health has issued the following resource that indicates:

“Restaurants should be closed for in-restaurant seated dining and should be open only to drive-through or other pick-up/delivery options.”

The California Department of Beverage Control has also issued the following:

“For any licensee with on-sale retail privileges, the guidance indicates you should cease exercising those privileges immediately. Further, you should follow the directive from Public Health to cease on-restaurant seated dining.”
